ECMC Freedom of Information Law (FOIL)
Erie County Medical Center Corporation (ECMC) has established a formal policy to ensure compliance with the New York State Freedom of Information Law (FOIL), as set forth in Article 6 (§§ 84–90) of the Public Officers Law. These procedures are designed to promote transparency and public access to information, while also safeguarding patient privacy, employee confidentiality, and sensitive operational data. ECMCC is committed to openness and transparency while ensuring the privacy and safety of our patients, staff, and community.
This page provides an overview of FOIL, outlines how members of the public may request access to ECMC records, and explains how the hospital processes and responds to such requests in accordance with applicable laws and regulations.
What is the New York Freedom of Information Law (FOIL)?
The New York Freedom of Information Law (FOIL), found in Article 6 (§§ 84–90) of the New York Public Officers Law, gives the public the right to access records maintained by government agencies. FOIL applies to a wide range of records, however, not all records are subject to disclosure. Certain categories of information may be withheld as permitted by law.
What is a “Record”?
A record includes any information kept, held, filed, or maintained by ECMCC in any format—paper or electronic.
How to Submit a FOIL Request to ECMC
To request records, you must submit a written FOIL request. Requests may be sent by email or mail and should include:
- A clear description of the records you are seeking
- Your name and contact information, including an email address for delivery of records and correspondence
- The date of your request

What Happens After You Submit a Request?
ECMCC will respond within the timeframes required by law:
- Within 5 business days: You will receive an acknowledgment of your request, along with an approximate date when a response will be provided (typically within 20 business days).
- If additional time is needed: You will receive an explanation and a revised estimated response date.
Possible Outcomes of a FOIL Request
After reviewing your request, ECMCC may:
- Provide the requested records
- Provide records with redactions (removal of protected information)
- Deny access to certain records if permitted by law
Fees
Fees are set in accordance with New York State law:
- $0.25 per page for paper copies (up to 9” x 14”)
- Actual cost for electronic records (if applicable)
- No fee for in-person inspection of records
Payment may be required before records are released.
Format of Records
Records will be provided in electronic format to reduce costs. If records are requested in an alternative format, ECMC will provide them in that format when reasonably available.
Appeals Process
If your request is denied in whole or in part, you have the right to appeal within 30 days.

- Appeals will be decided within 10 business days
- You will receive a written explanation of the decision
- You will be informed of your right to seek judicial review via Article 78 of the New York Civil Practice Law and Rules (CPLR)
Protection of Patient Information
ECMCC strictly protects patient privacy. FOIL does not override federal or state confidentiality laws. Protected health information will not be disclosed under any circumstances that violate applicable laws.
